On the heels of Ontario’s announcement that it has extended its pandemic emergency orders until at least September 22, 2020, the Attorney General has confirmed that the suspension of litigation deadlines and limitations periods will still be lifted on Monday, September 14, 2020.
The suspension was originally set to be lifted on September 11, 2020, but as that falls on a Friday, a decision has been made to resume procedural time periods and limitation periods on the following Monday (September 14) to avoid confusion. Limitation periods and other deadlines that were suspended starting March 16, 2020 will have been suspended for 26 weeks.
What this means for your case: Starting on September 14, 2020, previously suspended timelines (not otherwise affected by parties’ agreement or Court order) and limitations periods will pick up from the point in time from where they were on March 16, 2020. For example, if your case had a deadline on March 17, 2020 (one day after the suspension was imposed) your new deadline will be September 15, 2020 (one day after the suspension is lifted).
